What can I do if my German visa application is refused?

✓ Answered · 2 min read · 146 views

Today you have two routes: fix the reasons and file a new application, or bring a lawsuit at the Verwaltungsgericht Berlin (Administrative Court of Berlin) against the refusal. The Remonstration procedure at the mission was abolished on 01.07.2025, so older advice to "send the consulate a letter within one month" no longer applies.

1. Read the refusal notice carefully

The reasons and the information on legal remedies (Rechtsbehelfsbelehrung) in the notice tell you what you can do and by when. First pin down the reason: is it something you can fix, such as missing or insufficient documents, insufficient proof of funds or an unclear study plan?

2. New application

  • Possible at any time; as a rule it costs a fee again.
  • Add documents that directly address the reason for refusal (e.g. the missing document, updated proof of funds, a clearer study plan).
  • Apply through the mission's current channel (in Türkiye, the Auslandsportal for study visas) and its current checklist.

If the reason is a fixable gap, this is usually the most practical route.

3. Lawsuit (Verwaltungsgericht Berlin)

  • Must be filed within one month of notification of the refusal; the exact deadline is stated in the Rechtsbehelfsbelehrung.
  • The lawsuit involves court fees. A lawyer is not mandatory at first instance, although you may want legal advice.
  • There is no fixed duration; this route mainly makes sense if you believe the decision is legally wrong.

In short

Understand the reason, then either reapply with the gaps fixed or sue within the deadline. If your refusal notice states a different deadline or court, that information prevails.
