Can I rent long-term in Germany while unemployed by prepaying a year's rent?

✓ Answered · 2 min read · Community · 111 views

It is legally possible but rarely a good idea, and it is a classic fraud pattern.

  • Deposit limit: a landlord may demand a security deposit of at most three months' basic rent (§ 551 BGB), payable in three monthly instalments. A full year's rent in advance is not a deposit; it is a voluntary prepayment of rent that the law does not require and does not protect in the same way.
  • What landlords actually check: proof of income or financing (for students: blocked account, scholarship, parental guarantee), a credit report (Schufa) and ID. Offering a large prepayment instead can make serious landlords suspicious rather than reassured.
  • Fraud risk: adverts that ask for a prepayment or deposit before a viewing, keys "sent by courier", or landlords "abroad" are scams. Never transfer money before you have seen the flat, met the landlord or agent, and received a signed lease. Prefer a bank transfer with the lease reference over cash or payment services.

Better alternatives if you have no income yet:

  • a guarantor (Mietbürgschaft) from a parent or relative, or a rent guarantee from a bank or insurer;
  • student halls through the Studentenwerk, which check enrolment rather than income;
  • a room in a shared flat (WG) or a furnished temporary rental for the first months, then a long-term lease once you have a job or enrolment confirmation.

If you do agree a prepayment with a verified landlord, put it in the lease explicitly as prepaid rent for named months, with the refund rule if the lease ends early.
